Terms and Conditions

1. Sale Dates & Location

This estate sale will take place on October 26 & 27, 2024. Sale hours will be clearly stated and no early entry will be permitted.

2. Payment Terms

Accepted Payment Methods: We accept cash, major credit cards (Visa, MasterCard, American Express, and Discover), and bank-approved checks with proper identification.

Full Payment Due at Time of Purchase: All items must be paid in full before they are removed from the premises. No exceptions.

All Sales Are Final: No refunds, returns, or exchanges will be accepted under any circumstances.

3. Items Sold “As Is, Where Is”

All items are sold on an “as is, where is” basis.

No Warranties or Guarantees: Topwells Auction and the estate make no guarantees or warranties, either express or implied, regarding the condition, functionality, or authenticity of any items.

4. Inspection of Items

Buyers are responsible for thoroughly inspecting items before purchasing.

No Claims After Sale: Once items are purchased, no claims regarding defects, condition, or missing parts will be entertained.

5. Removal of Purchased Items

Responsibility for Removal: Buyers are responsible for removing all purchased items by the close of the sale on October 26, 2024.

Bring Help for Large Items: Topwells Auction staff will not assist in the removal, packing, or loading of large or heavy items. Buyers are encouraged to bring their own help and appropriate vehicles.

Storage Fees: Any items not removed by the specified deadline may be subject to storage fees or forfeiture.

6. Liability

Buyer’s Risk: Buyers assume all risks related to the removal and transport of items purchased. Topwells Auction is not responsible for accidents, damage, or injury sustained during the removal of items from the premises.

No Liability for Damages: Topwells Auction and the estate are not liable for any damages resulting from defects, issues, or use of purchased items.

7. Right to Refuse Sale

Topwells Auction reserves the right to refuse sale to anyone for any reason, including but not limited to improper behavior, failure to comply with the terms and conditions, or non-payment.

8. Bidding and Pricing

Fixed Pricing: Some items may be sold at fixed prices, while others may be open to bidding.

Bidding Discretion: In the event of a dispute over bidding, Topwells Auction reserves the right to determine the winning bidder or reopen bidding as deemed appropriate.

9. Sales Tax

New York State sales tax will be applied to all purchases unless a valid resale certificate is presented at the time of purchase.

10. Photography and Recordings

No unauthorized photography, video, or audio recordings are permitted on the sale premises.
